28-1381


If you are charged with 28-1381, you are charged with a Regular DUI in a City Court, Justice Court, or Superior Court in Arizona.

Can I Be Convicted of DUI When I Had Stopped Driving / While Parked? Experienced DUI Defense Lawyer - AZ DUI Team


The answer to this is "Maybe."  It really depends on how good your DUI Lawyer is.

This type of situation is one of the best cases to argue, and it is one of the most important types of cases in which to have an Experienced DUI Defense Lawyer.

If you had properly parked your vehicle, it should be impossible to be convicted of "Driving" Under the Influence.

In Arizona, there is an argument that can be made separately to the judge and the jury, and it basically goes like this:  

There is a societal interest in people getting off the roadway and sleeping off the drunkenness or impairment.  If these responsible people who decide that they should not be driving because they have had too much to drink, or their medication is unexpectedly impairing them, is at risk of getting arrested for DUI because they leave themselves out in the open, the system is encouraging people to continue driving impaired in order to get home where they won't be hassled by officers... and maybe even drive faster so they are on the road for less time.

People may have made a mistake by drinking too much, or taking too much medication or at the wrong time, but a person who is responsible enough to realize that they are too impaired to drive should not be punished for doing the right thing and pulling off the roadway in an attempt to sober up.

Can I Get Charged / Convicted of DUI When I Was Only Taking My Prescription Medication? Experienced DUI Defense Lawyer - AZ DUI Team

This is becoming a more and more common question, and, unfortunately, the answer is Yes and Yes:  a person can be charged and convicted of DUI solely due to the medications they were taking.

Just about everyone in Arizona is charged with two or more counts of Misdemeanor or Felony DUI.  It is two or more ways the prosecutor can try to prove you guilty at trial.

This is a common question after someone gets charged with a DUI, and it is really a personal decision... if you are given the option.

The Public Defenders Office is set up to represent "indigent" clients - people who cannot afford to hire a private attorney.  It is up to the individual court system and individual judges whether you are designated "indigent."

MY DUI Case Got " Scratched. " Can it Be Re-Filed or re-Charged? Experienced DUI Defense Lawyer - AZ DUI Team


Unfortunately, getting your DUI case "Scratched" is rarely a good thing.

Getting a case "Scratched" means that the case was dismissed, but that usually isn't the end of things.

Here are the good reasons why a DUI case might get "Scratched":
  • Evidence came back indicating that you were not impaired
  • Evidence came back that you did not have drugs or medications in your system
  • Your Blood Alcohol Content (BAC) was not as high as suspected
  • There is a problem with a necessary witness
Normally, however, a case is "Scratched" because the prosecutor doesn't yet have all the evidence in; or the usual culprit with a Misdemeanor DUI charge getting "scratched" is that the prosecutor found evidence that the Misdemeanor DUI could be charged as a Felony DUI.

The problem is that the prosecutor can bring a Misdemeanor DUI case against you for one year from the date of arrest.  In Felony DUI cases, the prosecutor can bring a case against you for seven years from the date of the arrest.

One of the other downfalls of having the case "Scratched" is that you have this Felony or Misdemeanor DUI case hanging over your head, whether you realize it or not.  And one day you may get picked up by the police and taken into custody because a warrant was issued for your arrest.

You would hope that if the prosecutor re-filed or re-charged the case, the court would notify you to show up, but it doesn't always work out that way.  Sometimes the court sends a summons to appear to the wrong address, an old address, or doesn't even bother sending one out, and just issues a warrant.

Can my California Prior Felony Conviction Be Used Against Me in My Arizona DUI Case? Experienced DUI Defense Lawyer - AZ DUI Team
